These Terms of Service (“Terms”) govern your access to and use of the softuriona website (the “Site”) operated by Softuriona Studio LLC (“softuriona”, “we”, “us”, or “our”). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. Acceptance of Terms

By visiting or using the Site, you confirm that you are at least 16 years old and that you have the legal capacity to enter into a binding agreement. If you are under 18, you may use the Site only with the involvement and supervision of a parent or legal guardian.

2. Scope of Services and Site Purpose

The Site provides information about softuriona, including studio location, opening hours, artists, services (such as tattoos, piercing, temporary tattoo concepts, and cover-ups/reworks), and a way to request a consultation. The Site is intended for general informational and enquiry purposes.

Booking availability, session length, pricing, and scheduling are confirmed by softuriona after we review your enquiry. Any estimate on the Site or in general communications is non-binding and may change based on design complexity, placement, and practical session requirements.

We may update, change, suspend, or discontinue any part of the Site at any time, including content, features, or availability of information, without liability.

3. Studio Statements and Service Disclaimers

The Site describes our studio process and safety measures. However, results in tattooing and piercing depend on multiple factors, including skin characteristics, placement, aftercare adherence, and lifestyle friction during healing. Outcomes can vary.

  • All services are performed by professional artists using a controlled studio process.
  • We follow sanitary standards and safety procedures as part of every station reset.
  • Clients are responsible for their final decisions on design and placement after consultation.

The Site does not provide medical advice. If you have allergies, skin conditions, contraindications, healing concerns, or you are under a clinician’s care, you should obtain professional medical guidance before receiving any tattooing or piercing services.

4. Acceptable Use

You agree to use the Site in a lawful manner and not to misuse it. Prohibited activity includes:

  • Attempting to gain unauthorized access to the Site, its server, or any connected system.
  • Submitting false, misleading, or impersonated information in any form submission.
  • Uploading or transmitting malware, malicious code, or content that disrupts the Site’s operation.
  • Scraping, crawling, or harvesting content or data from the Site in an automated manner without permission.
  • Bypassing or attempting to bypass rate limits, anti-bot measures, or security-related restrictions.
  • Using the Site to send unsolicited communications, spam, or bulk submissions.

We may block, throttle, or otherwise restrict access where we reasonably believe traffic is abusive, automated, or poses security risk, including patterns consistent with credential stuffing, form flooding, or denial-of-service attempts.

5. Intellectual Property

The Site and its content (including text, design elements, layout, logos, and studio descriptions) are owned by or licensed to Softuriona Studio LLC and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes. You may not copy, reproduce, modify, distribute, publicly display, or create derivative works from the Site content without our written permission.

Artist portfolios, sketches, and custom compositions are protected works. Where portfolio material is displayed on the Site, it is for viewing only and may not be reused without permission.

6. Third-Party Services and Links

The Site may reference third-party services that support basic functionality, such as embedded mapping. We are not responsible for third-party content, policies, or practices. Your use of third-party services is governed by their own terms and privacy policies.

Except where required for essential functionality (for example, maps), we avoid suspicious external links and do not provide links intended to mislead visitors. If you believe a link is unsafe or incorrect, contact us so we can review it.

7. Disclaimer of Warranties

The Site is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

We do not guarantee that the Site will be uninterrupted, error-free, secure, or free from harmful components. Information on the Site may not always reflect the most recent availability, artist schedules, or operational changes.

8. Limitation of Liability

To the maximum extent permitted by law, Softuriona Studio LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or business interruption, arising out of or relating to your use of (or inability to use) the Site.

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Site will be limited to the greater of (a) the amount you paid to us in the prior 12 months for services purchased through your interaction with us, or (b) ÂŁ100.

Nothing in these Terms limits liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

9. Indemnification

You agree to indemnify and hold harmless Softuriona Studio LLC from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to: (a) your misuse of the Site; (b) your breach of these Terms; or (c) your violation of applicable law.

10. Force Majeure

We will not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including natural disasters, fire, flood, war, terrorism, labor disputes, power or network outages, cyberattacks, or failure of hosting or third-party infrastructure.

11. International Use

The Site is operated from the United Kingdom. We do not represent that the Site is appropriate or legally available for use in all jurisdictions. If you access the Site from outside the UK, you do so on your own initiative and are responsible for compliance with local laws.

12. Governing Law and Venue

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles. You agree that the courts of London, England will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Site, except where mandatory consumer protection laws in your country of residence require otherwise.

13. Dispute Resolution

Before filing a claim, you agree to contact us and allow a 30-day informal resolution period. Many issues can be resolved quickly by clarifying facts, correcting a record, or addressing technical problems with the Site.

For EU/UK consumers, you may also have rights to bring proceedings in your local courts under applicable consumer laws. Nothing in these Terms is intended to limit those statutory rights.

14. Termination

We may suspend or terminate your access to the Site if we reasonably believe you have violated these Terms or engaged in activity that threatens the security or integrity of the Site. Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, and governing law will survive termination.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Softuriona Studio LLC regarding your use of the Site and supersede any prior or contemporaneous agreements or communications.

17. Assignment

We may assign or transfer these Terms, in whole or in part, in connection with a merger, acquisition, corporate reorganization, or sale of assets. You may not assign these Terms without our prior written consent.

18. No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver must be in writing and signed by an authorized representative of Softuriona Studio LLC.

19. Modifications to These Terms

We may update these Terms from time to time. Changes will become effective 14 days after they are posted on this page, unless a change is required by law or is needed to address an urgent security issue (in which case it may be effective immediately). The “Last Updated” date above reflects the latest version.

20. Electronic Communications

You consent to receive communications from us electronically, such as by email or by notices on the Site. You agree that all agreements, notices, disclosures, and other communications that we provide electronically satisfy any legal requirement that such communications be in writing, to the extent permitted by applicable law (including the UK Electronic Communications Act 2000, the EU eIDAS framework where applicable, and the US E-SIGN Act where relevant).
