1. Acceptance of Terms and Eligibility

By using the Site, you confirm that you (a) have read and understood these Terms, (b) have the legal capacity to enter into a binding agreement, and (c) will comply with all applicable laws and regulations. If you do not agree to these Terms, do not use the Site. If you are using the Site on behalf of an organization (for example, booking training for a team), you represent that you have authority to bind that organization to these Terms.

2. Educational Nature of Photography Training

Riko Photography Academy provides photography education and related professional guidance. Any information on the Site about course topics, learning outcomes, examples, workflows, and suggested practice routines is provided for educational and informational purposes. Photography results depend on many factors such as experience level, time invested, equipment limitations, subject cooperation, weather, location constraints, and production conditions.

We do not make guarantees about business income, employment, client acquisition, portfolio outcomes, or any specific commercial results. Any references to “client-ready” work reflect a focus on practical deliverables (for example, predictable exposure, consistent color, and disciplined exports) rather than a promise of financial or career outcomes.

3. Description of the Site and Services

The Site provides information about our photography courses offered in the Netherlands, including course tracks, session formats, and how to contact us. The Site may also include guidance related to studio lighting setups, exposure decision-making, editing workflow discipline (including culling and export presets), and professional delivery practices such as file naming and proofing routines.

We may update, modify, suspend, or discontinue any part of the Site at any time. We also may update course content over time to reflect practical changes in camera systems, software workflows, or operational standards used by working photographers and creative teams in the Netherlands.

4. Contact Requests and Communications

When you submit a contact request, you agree to provide accurate information and to avoid including sensitive personal data that is not required for a course inquiry. Typical information includes your name, email address, phone number (optional), a course interest selection, and a message describing your current level and goals.

Our goal is to respond within one business day (Monday to Friday), but response times can vary due to holidays, course delivery periods, or unusually high inquiry volume. 5. Acceptable Use

You agree not to misuse the Site. In particular, you must not:

• Attempt to gain unauthorized access to any part of the Site, systems, or networks.
• Use automated tools (including scraping, crawling, or harvesting) to collect content or data from the Site without our written permission.
• Submit false, misleading, or impersonated information through contact forms or email.
• Distribute malware, attempt phishing, or interfere with the Site’s availability or security.

6. Intellectual Property

The Site and all content on it, including text, course descriptions, structure, design elements, and branding, are owned by or licensed to Riko B.V. and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Site for personal and internal business purposes related to learning about our courses and contacting us.

You may not reproduce, republish, distribute, publicly display, or create derivative works from our content without prior written permission, except where such use is permitted by mandatory law. Any unauthorized use may violate copyright, trademark, or other laws.

7. Third-Party Services and External Links

The Site may reference third-party services that are commonly used in photography workflows (for example, camera manufacturers, editing software, or file-delivery tools). These references are provided for context and do not constitute endorsement, warranty, or a guarantee of fitness for your needs.

8. Disclaimers of Warranties

The Site is provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, we disclaim all warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components. We do not warrant that any information on the Site will be complete or current at all times, particularly where schedules and availability depend on operational constraints.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Riko B.V. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or related to your use of (or inability to use) the Site.

To the maximum extent permitted by applicable law, our total liability for any claim arising out of or related to these Terms or the Site will not exceed the greater of (a) the amount you paid to us in the 12 months prior to the event giving rise to the claim, or (b) EUR 100.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for intent (opzet) or gross negligence (grove schuld) where such exclusions are not permitted.

10. Indemnification

You agree to indemnify and hold harmless Riko B.V., its directors, officers, employees, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to your misuse of the Site, your violation of these Terms, or your violation of applicable laws or third-party rights.

11. Force Majeure

We are not responsible for delays or failures in performance resulting from events beyond our reasonable control, including natural disasters, fire, war, terrorism, labor disputes, pandemics, government actions, interruptions to internet or cloud providers, and cyberattacks affecting infrastructure.

12. International Use

The Site is operated from the Netherlands and is intended primarily for individuals and organizations seeking photography courses in the Netherlands. We make no representation that the Site is appropriate or available for use in all locations. You are responsible for complying with local laws where you access the Site.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles. Unless mandatory consumer protection laws provide otherwise, any dispute arising out of or relating to these Terms or the Site shall be submitted to the competent courts of Noord-Holland, the Netherlands.

If you are a consumer habitually resident in the European Union, you may also have the right to bring proceedings in the courts of your place of residence, and mandatory consumer rights under applicable law remain unaffected.

14. Dispute Resolution (Informal First)

Before filing a formal complaint or initiating court proceedings, you agree to contact us and attempt to resolve the issue informally. 15. Termination

We may suspend or terminate your access to the Site at any time if we reasonably believe you have violated these Terms or if your use creates risk for the Site, other users, or our operations. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will remain in effect.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The invalid or unenforceable provision will be replaced by a valid provision that most closely reflects the original intent.

17. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Riko B.V. regarding the Site, and supersede any prior or contemporaneous understandings regarding the Site.

18. Assignment

We may assign or transfer these Terms, in whole or in part, including to an affiliate or successor in interest, in connection with a corporate reorganization, merger, acquisition, or sale of assets. You may not assign these Terms without our prior written consent.

19. No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision. Any waiver must be in writing and signed by an authorized representative of Riko B.V.

20. Changes to These Terms

We may update these Terms from time to time to reflect changes to the Site, changes in our operations, or changes in applicable laws. Updated Terms will be posted on this page and will become effective 14 days after posting, unless a different effective date is stated. Your continued use of the Site after the effective date constitutes acceptance of the updated Terms.

21. Electronic Communications

You agree that communications between you and us may take place electronically, including by email and through the Site. To the extent permitted by applicable law, electronic communications and records satisfy any legal requirement that such communications be in writing.
